1. Acceptance of Terms

By accessing or using CompetitorIQ ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service. These Terms constitute a binding agreement between you and Ray Johnson ("we," "us," or "our"), operating CompetitorIQ.

2. Description of Service

CompetitorIQ is an AI-powered competitor intelligence tool for local businesses. The Service uses the Google Places API to retrieve publicly available business data and reviews, and Anthropic's Claude AI to generate competitive analysis reports ("Reports"). Reports include competitor strengths, weaknesses, and suggested competitive tactics.

3. AI-Generated Content Disclaimer

All analysis, recommendations, and strategies produced by CompetitorIQ are AI-generated and provided for informational purposes only. We make no representations or warranties regarding the accuracy, completeness, or fitness for any particular purpose of any Report.

You acknowledge that AI-generated content may contain errors, omissions, or inaccuracies. Do not rely solely on CompetitorIQ Reports for making significant business decisions. You are responsible for independently verifying any information before acting on it.

4. Payments

CompetitorIQ offers two paid plans:

  • One Report – $27.00 (one-time): Single full competitor report with permanent access.
  • Monthly Access – $49.00/month: Unlimited reports. Billed monthly. Cancel anytime.

All payments are processed securely through Stripe. By completing a purchase you also agree to Stripe's Terms of Service. Prices are in USD and subject to change with notice.

5. Refunds

Please review our full Refund Policy before purchasing. In summary:

  • One-time reports are non-refundable once the full report has been generated and delivered.
  • Monthly subscriptions may be cancelled at any time. No partial-month refunds are issued.
  • If you experience a technical failure that prevented delivery of your Report, contact us within 7 days for a full refund.

6. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any regulations.
  • Attempt to scrape, copy, or redistribute Report data at scale for resale.
  • Reverse-engineer, decompile, or otherwise tamper with the Service.
  • Use the Service to harass, defame, or harm any individual or business.

7. Third-Party Services

The Service relies on third-party providers including Google Places API, Anthropic, Stripe, and Supabase. We are not responsible for the availability, accuracy, or actions of these third-party services. Your use of their services is governed by their respective terms and policies.

8. Intellectual Property

The CompetitorIQ name, logo, and website design are owned by Ray Johnson. Reports generated for you are licensed to you for your own internal business use only. You may not resell, sublicense, or commercially redistribute Reports without our prior written consent.

9. Limitation of Liability

To the maximum extent permitted by applicable law, Ray Johnson shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service, even if advised of the possibility of such damages.

Our total liability for any claim arising from your use of the Service shall not exceed the amount you paid us in the 30 days preceding the claim.

10. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of the Commonwealth of Pennsylvania, USA, without regard to its conflict of law provisions. Any disputes shall be resolved exclusively in the courts of Pennsylvania.

12. Changes to These Terms

We may update these Terms at any time. We will post the updated Terms on this page with a new "Last updated" date. Continued use of the Service after changes constitutes acceptance of the revised Terms.
